The Player is not required to
participate in GreatShot.com.Participation in Greatshot.com is at the Player’s
sole option, discretion and risk and is for entertainment purposes only
.

The Player must be of legal age of
majority in his or her jurisdiction to be eligible to participate in
GreatShot.com.The Player must also be someone who can form legally binding
contracts in his or her jurisdiction.If you do not qualify, please do not
participate in GreatShot.com.

Fuzzy Zoeller Productions (herein
“the Company) shall not be liable for computer malfunctions.A “Computer
malfunction” includes, but is not limited to, web server error or delay,
internet congestion, loss of data, power outages, viruses, or any other
operational upset.The Company shall not be liable for attempts by the Player
to participate in GreatShot.com by methods, means or ways not intended by the
Company.

Errors due to the technological
limitations of the Player (including, but not limited to, operating system,
web browser software, line connection speed, service provider, and computer
hardware and software) are the sole responsibility of the Player, not of the
company.No refunds will be given.

In no event will the company or
anyone else involved in creating, producing or using any or all of the
products or other services involved in GreatShot.com be liable for any lost
data, lost profits, or for any indirect, incidental, special, consequential,
exemplary or punitive damages arising out of or relating to the software or
services provided by the company.
The company’s liability to the player or to any third party in any
circumstance is limited to the net amount of fees paid to the company by the
player (amount paid by player to company minus amount donated to charity or
minus retail value of goods received) for the event which gave rise
to the liability.

The company shall not be
responsible for maintaining the Player’s user name and password should the
Player lose, forget or misplace the same.

Materials necessary to participate
in GreatShot.com (whether electronically obtained or obtained by other means)
are automatically void if counterfeited, mutilated, forged, altered, tampered
with, mechanically or electronically reproduced, obtained outside official
GreatShot.com channels, or if they contain printing, production, topography,
mechanical, electronic or other errors.

The Player is solely responsible
for paying applicable federal, state or local income taxes on any
prize.

The Player is solely responsible
to determine tax deductibility of donations made via
GreatShot.com.

The Player consents to the use of
his or her name and likeness for advertising and promotional purposes without
additional compensation.

The Player shall conform precisely
and exactly to the GreatShot.com rules or be subject to immediate
disqualification without a refund at the sole discretion of the
Company.

The Player shall hold the Company,
its employees, officers, directors, licensees, distributors, wholesalers,
affiliates, subsidiaries, advertising, promotion or other agencies, media
partners, agents and retailers harmless and shall fully indemnify the same
from any and all costs, expenses, liabilities and damages, including
attorney’s fees, that may arise as a result of the Player’s use of the
GreatShot.com website and the materials involved in GreatShot.com, including
any such costs arising from “computer malfunctions” (as defined in Paragraph 3
of these Terms and Conditions) attributable to the Player’s use of the
Greatshot.com website, whether intentional or
unintentional.

The Player agrees not to copy,
reproduce, alter, modify, create derivative works, or publically display any
content from GreatShot.com without the prior expressed written consent of the
Company.

The Company makes no
representations or warranties, implied or explicit, as to the legal right for
the Player to participate in GreatShot.com.

Any controversy or claim arising
out of or relating to this Agreement shall be settled by binding arbitration
in accordance with the commercial arbitration rules of the American
Arbitration Association.Any such controversy or claim shall be arbitrated on
an individual basis, and shall not be consolidate in any arbitration with any
claim or controversy of any other party.The arbitration shall be conducted in
New Albany, Indiana and judgment on the arbitration award may be entered into
any court having jurisdiction thereof.Either the Player or the Company may
seek any interim or preliminary relief from a court of competent jurisdiction
in New Albany, IN necessary to protect the rights or property of the Player or
the Company pending the completion of the arbitration.

The terms and conditions contained
herein represent the complete, final and exclusive agreement between the
Player and the Company

If You Become a Paying Member your Membership is
indefinite and you will be able to compete each day until your Membership is cancelled. You may
cancel your Membership at any time by notifying Customer Care. Your cancellation will be effective
on the date of your next scheduled payment as long as the notification is sent no later than two (2)
business days prior to your Membership renewal date.
